Liability Release for Workouts Provided by Flourish Fitness App:

By using the Flourish Fitness mobile application ("the App"), you acknowledge and agree to the following terms and conditions concerning the workouts and exercises provided therein:

Assumption of Risk:

You understand and acknowledge that participating in physical exercise, including workouts provided through the Flourish Fitness app, carries inherent risks of injury or harm. These risks may include, but are not limited to, strains, sprains, muscle soreness, joint injuries, and in rare cases, serious injury or death.

Consultation with Healthcare Professional:

Prior to engaging in any workout program provided by the Flourish Fitness app, it is strongly recommended that you consult with a qualified healthcare professional, especially if you have any pre-existing medical conditions, injuries, or concerns regarding your physical health. You agree that it is your responsibility to determine whether you are physically capable of participating in any exercise or workout routine provided by the app.

Voluntary Participation:

Your use of the Flourish Fitness app and participation in any workout or exercise routines provided therein is voluntary. You freely choose to engage in these activities, understanding the risks involved.

Release of Liability:

To the fullest extent permitted by law, you hereby release, discharge, and hold harmless Flourish Fitness, its affiliates, employees, agents, and partners from any and all claims, liabilities, damages, injuries, or expenses (including legal fees) arising out of or in any way related to your use of the Flourish Fitness app or participation in any workout or exercise routines provided therein. This includes, but is not limited to, claims for negligence, breach of contract, or breach of statutory duty.

Indemnification:

You agree to indemnify and hold harmless Flourish Fitness, its affiliates, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with your use of the Flourish Fitness app, including any violation of these terms and conditions.

No Warranty:

Flourish Fitness makes no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of the information, workouts, or exercises provided through the app. All content is provided "as is" and without warranty of any kind.

Modification of Terms:

Flourish Fitness reserves the right to modify or update these terms and conditions at any time without prior notice. It is your responsibility to review these terms periodically for any changes. By using the Flourish Fitness app, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you must not use the Flourish Fitness app or participate in any workouts provided therein.
